Overview

Welcome to the Policy on Privacy and Confidentiality of The Alvan Ikoku Philanthropies, a division of The Alvan Ikoku Group LLC. The Ikoku Philanthropies holds confidentiality and privacy to be of high importance, and is committed to conceptions of privacy and confidentiality as a set of fundamental, inalienable and often absolute rights.

Therefore, persons engaged in any activity involving, referring to, relating to, or otherwise pertaining to The Ikoku Philanthropies are expected to take the time to read the Policy on Privacy and Confidentiality below carefully.

Your Agreement

— With respect to the Agreement you enter into with The Ikoku Philanthropies via the Policy on Privacy and Confidentiality, you understand and adhere to the following:

Persons Adhering to Agreement
that the Policy on Privacy and Confidentiality is to be adhered to by a wide range of associated individuals and communities ― including but not limited to board and committee members, leadership, management, officers, staff, employees, volunteers, representatives, agents, collaborators, partners, and visitors and users ― as they work in their capacity to establish, further develop, operate, collaborate with, carry out the mission and purposes of, and also visit, use and participate in the offerings of The Ikoku Philanthropies.
Applicability and Governance of Agreement
that the Policy on Privacy and Confidentiality governs any and all of your access, actions, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies, its series, subsidiaries, and affiliates, and the Products and Services.
Entry and Continuation of Agreement
that whenever you engage in any access, action, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies, the divisions, series, subsidiaries, or affiliates, and the Products and Services — directly or indirectly as further described below — you are agreeing to the Policy on Privacy and Confidentiality as well as the associated Codes and Policies that collectively constitute The Ikoku Philanthropies User Agreement and Code of Conduct, as they are amended from time to time.
Direct and Indirect Entry and Continuation of Agreement
that whenever you engage in the above described activities directly or indirectly — whether engaged in through The Ikoku Philanthropies, the divisions, series, subsidiaries, or affiliates, and the Products and Services; or through persons and entities working with The Ikoku Philanthropies, the divisions, series, subsidiaries, or affiliates, and the Products and Services; or working with such engaged activities and resulting media, materials, or otherwise — you are also agreeing to the Policy on Privacy and Confidentiality as well as the associated Codes and Policies that collectively constitute The Ikoku Philanthropies User Agreement and Code of Conduct, as they are amended from time to time.
Binding Nature and Validity of Agreement
that you are also thus indicating that you understand the Policy on Privacy and Confidentiality and the Codes and Policies, that you intend them to be the legal equivalent of a signed, written contract, equally binding, and that you accept such Policy on Privacy and Confidentiality and Codes and Policies and agree to be legally bound by them (your “Agreement”).
Agreement On Behalf of Organization
that if you are engaging in any of the above described activities, communication, or uses for or on behalf of an organization, you are agreeing to this Agreement on behalf of that organization, and represent and warrant that you can do so.
In Case of Non-Agreement or Inability to Honor
that you will not engage in any of the above described activities, communication, or uses if you do not agree to all of the Policy on Privacy and Confidentiality or the Codes and Policies or if your jurisdiction will not honor them.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

Your Consent to The Policy

— With respect to your ability to agree and consent to the Policy on Privacy and Confidentiality, you represent and warrant the following:

Your Power and Authority
that you have the power and authority to enter into the agreement entailed in the Policy on Privacy and Confidentiality, including, where applicable, the power and authority to enter into the agreement on behalf of an organization.
Required Age or Permission and Supervision
that you are at least eighteen (18) years old or if younger at least thirteen (13) years old and engage in activity, communication, operation, participation, visit, or other use in relation to The Ikoku Philanthropies, its series, subsidiaries, and affiliates, or the Products and Services with the permission and supervision of an adult parent or guardian.
Reading and Understanding
that you have read and understood the Policy on Privacy and Confidentiality.
Voluntary Nature of Consent
that you understand your consent to be voluntary in nature.
Agreement and Consent
that you consented to and agreed to be legally bound by the Policy on Privacy and Confidentiality.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree that your consent meets the conditions, principles, and requirements for consent, as delineated and described in a the Codes and Policies — for the specific purpose of consenting to this Policy, the Agreement and the Codes and Policies.

Your Abiding by The Policies

— You represent, warrant, and covenant that, given the above attestation about your consent to the Policy on Privacy and Confidentiality, you have read, understood, consented to, and agreed to be legally bound by and abide by the Policy on Privacy and Confidentiality and the Codes and Policies, in their entirety without modification, including as they are amended from time to time by The Ikoku Philanthropies.

Your Understanding of Privacy

— You represent, warrant, and covenant that, given the above attestation about your consent and adherence to the Policy on Privacy and Confidentiality, you have also read, understood, consented to, and agreed to be legally bound by and abide by understandings of privacy and privacy rights as defined in all applicable guidelines, law, and regulation, by The Ikoku Philanthropies in the Codes and Polices and as further delineated below, to be respected and not violated, in any way, by you.

Your Understanding of Confidentiality

— You represent, warrant, and covenant that, given the above attestation about your consent and adherence to the Policy on Privacy and Confidentiality, you have also read, understood, consented to, and agreed to be legally bound by and abide by understandings of confidentiality and confidentiality rights as defined in all applicable guidelines, law and regulation, by The Ikoku Philanthropies in the Codes and Polices and as further delineated below, to be respected and not violated, in any way, by you.

Your Commitment to Understandings

— You also represent, warrant, and covenant that, given the aforementioned attestation, your commitment to this understanding of privacy and confidentiality shall entail the following:

Basis for Your Actions, Activity and Decisions
its basis for any activity you engage in with respect to The Ikoku Philanthropies — including its series, subsidiaries, and affiliates, as well as the Products and Services — and that any such actions and decisions you engage in shall be free of any incompatibility with, inconsistency with, or violation of the Policy on Privacy and Confidentiality or any equivalent or applicable guidelines, laws, policies, provisions, or regulations.
Commitment to Privacy Rights and Protections
that this commitment include but not be limited to upholding everywhere and for every person at The Ikoku Philanthropies the most humane, protective, respectful, robust and strictest interpretations of privacy rights and protections, including as such rights and protections are provided for in Australia, Brazil, Canada, France, Germany, India, Japan, New Zealand, Nigeria, South Africa, the European Union and the Council of Europe, the United Kingdom, repeatedly in the United Nations — where “the human right to privacy” requires that “no one shall be subjected to arbitrary or unlawful interference with his or her privacy, family, home or correspondence” as well as an attendant “right to the protection of the law against such interference” — repeatedly in the United States — where federal and state legislation and jurisprudence have derived and further developed the “right to tranquility” and a number of delineated “rights to privacy” from the Preamble of the US Constitution and its Amendments — and explicitly in California, as in the constitutional principle codified in the State Constitution of California that “all people are by nature free and independent and have inalienable rights” to “enjoying and defending life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.”
Commitment to Confidentiality Rights and Protections
that this commitment include but not be limited to upholding everywhere, for every person, and for all confidential, personal, private and sensitive data and information at The Ikoku Philanthropies the most humane, protective, respectful, robust and strictest interpretations of confidentiality rights and protections, including as such rights and protections are provided for in Australia, Brazil, Canada, France, Germany, India, Japan, New Zealand, Nigeria, South Africa, the European Union and the Council of Europe, the United Kingdom, the United Nations, and the United States, and ratified in principles for confidentiality compliance codified pursuant to the United States Health Insurance Portability and Accountability Act, to ‘‘maintain reasonable and appropriate administrative, technical, and physical safeguards to ensure the confidentiality and integrity” of data and information.
Commitment to Respectful and Protective Practices
that you respectfully assist solely by duties described below in this Policy and in no way interfere with or impede the reasonable efforts taken by The Ikoku Philanthropies to translate the above commitments into practices for developing and maintaining protections pertaining to privacy and confidentiality; for determining compliance with those protections; and for fulfilling, respecting, and safeguarding persons, properties, and interests relating to privacy and confidentiality, privacy and confidentiality processes, privacy and confidentiality principles, privacy and confidentiality rights, and their protections, including but not limited to those delineated in this Policy and the Codes and Policies.
Commitment to Protections Following and Ahead of the Law
that you also respectfully assist solely by duties described below in this Policy and in no way interfere with or impede the reasonable efforts taken by The Ikoku Philanthropies to adopt a coupled approach to legal and substantive protections for privacy and confidentiality derived, in part, from the provision of rights and protections via advances in law and regulation, but also often beyond what the law provides for and protects with respect to privacy and confidentiality — such as basic standards for privacy and confidentiality rights and protections set in several privacy laws in California and the constitutional right to privacy provided for in the State Constitution of California, as well as in the California Consumer Privacy Act, the European Union General Data Protection Regulation, and the United States Health Insurance Portability and Accountability Act.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

Your Duty to the Policy

— With respect to your duty to the Policy on Privacy and Confidentiality, you represent and warrant that you understand and shall adhere to such duty by way of the following:

Refraining from Any Intentional Breach or Violation
avoiding, refraining from, and stopping any access, action, activity, communication, operation, or other use and any collaboration, collusion, coordination, planning, or other preparation you or any person engage in that may encourage, result in, or otherwise foster any intentional breach or violation of the Policy on Privacy and Confidentiality; any intentional breach, diminishment, disruption, impediment, interference, or pertaining to privacy and confidentiality guidelines, laws, policies, provisions, or regulations, or other privacy and confidentiality protections or rights of The Ikoku Philanthropies and the sole Founder, Owner, and President; and any intentional breach, diminishment, disruption, impediment, interference, or other violation pertaining to the independent and sole control and determination of the above by the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku.
Refraining from Any Unintentional Breach or Violation
avoiding, refraining from, and stopping any access, action, activity, communication, operation, or other use and any collaboration, collusion, coordination, planning, or other preparation you or any person engage in that may encourage, result in, or otherwise foster any unintentional breach or violation of the Policy on Privacy and Confidentiality; any unintentional breach, diminishment, disruption, impediment, interference, or pertaining to privacy and confidentiality guidelines, laws, policies, provisions, or regulations, or other privacy and confidentiality protections or rights of The Ikoku Philanthropies and the sole Founder, Owner, and President; and any intentional breach, diminishment, disruption, impediment, interference, or other violation pertaining to the independent and sole control and determination of the above by the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku.
Reporting Any Intentional Breach or Violation
reporting — directly and specifically to Alvan Azinna Chibuzo Ikoku, the Founder, Owner, and President of The Ikoku Philanthropies — any access, action, activity, communication, operation, or other use and any collaboration, collusion, coordination, planning, or other preparation you or any person engage in that may encourage, result in, or otherwise foster any intentional breach or violation of the Policy on Privacy and Confidentiality; any intentional breach, diminishment, disruption, impediment, interference, or pertaining to privacy and confidentiality guidelines, laws, policies, provisions, or regulations, or other privacy and confidentiality protections or rights of The Ikoku Philanthropies and the sole Founder, Owner, and President; and any intentional breach, diminishment, disruption, impediment, interference, or other violation pertaining to the independent and sole control and determination of the above by the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku.
Reporting Any Unintentional Breach or Violation
reporting — directly and specifically to Alvan Azinna Chibuzo Ikoku, sole Founder, Owner, and President of The Ikoku Philanthropies — any access, action, activity, communication, operation, or other use and any collaboration, collusion, coordination, planning, or other preparation you or any person engage in that may encourage, result in, or otherwise foster any unintentional breach or violation of the Policy on Privacy and Confidentiality; any unintentional breach, diminishment, disruption, impediment, interference, or pertaining to privacy and confidentiality guidelines, laws, policies, provisions, or regulations, or other privacy and confidentiality protections or rights of The Ikoku Philanthropies and the sole Founder, Owner, and President; and any intentional breach, diminishment, disruption, impediment, interference, or other violation pertaining to the independent and sole control and determination of the above by the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku.
Determination of Compliance
not diminishing or interfering with, in any way, the ability, opportunity, and sole discretion and rights of The Ikoku Philanthropies and the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku, to determine compliance with the Policy on Privacy and Confidentiality and to have their decision be final and binding and not subject to challenge or appeal.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

Your Accordance with Ethics

— You represent, warrant, and covenant that, given the above attestation about your consent to this Policy, you ensure that your abiding by and adhering to its conditions, policies, principles, requirements, and rights shall further remain in accordance with the Founding and Governing Code of Ethics.

Your Accordance with Mission

— You represent, warrant, and covenant that, given the above attestation about your consent to this Policy, you ensure that your abiding by and adhering to its conditions, policies, principles, requirements, and rights shall further remain in accordance with the founding mission and purposes of The Ikoku Philanthropies and The Ikoku Group, without incompatibility, as described and delineated in the Codes and Policies and the Founder’s Agreement.

Further Considerations

Your Knowledge and Agreement

The Ikoku Philanthropies strongly recommends you develop and maintain your knowledge of all the Codes and Policies, and so asks that you read, understand, and regularly visit this section and other communications regarding the Policy on Privacy and Confidentiality, as well as the Codes and Policies. The Ikoku Philanthropies takes your continued access, activity, communication, engagement, operation, participation, and other use or visiting of the Products and Services, as active indication of your knowledge, understanding, and legally binding acceptance of and agreement to this Policy as well as the Codes and Policies.

Your Duty to Organizational Integrity

With respect to your attendant duty to organizational integrity — and your legally binding agreement to not diminish, interfere, or violate, in any way, its principles, protections, requirements, or rights — you represent and warrant that you understand and shall adhere to the following:

Your Duty to Policy
To protect the organizational integrity of The Ikoku Philanthropies and The Ikoku Group — as well as the properties, rights, and protections of the company division and its official persons — The Ikoku Philanthropies requires all natural and legal persons concerned to read, understand, abide by and, where applicable, sign contracts and agreements delineated and described in the Policy on Company and Division Integrity.
Your Acceptance of Policy
The Ikoku Philanthropies reminds you that the Policy on Company and Division Integrity forms part of The Ikoku Philanthropies User Agreement and Code of Conduct. Thus, The Ikoku Philanthropies takes your continued engagement in any activity involving, referring, relating, or otherwise pertaining to The Ikoku Philanthropies as active indication of your legally binding acceptance of this Policy as well as the Codes and Policies.
Your Acceptance of Sole Ownership
Furthermore, you represent, warrant, and covenant that, given the above, your continuation in using or visiting, in any way, The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, is an active indication of your legally binding acceptance of the sole administration, control, management, and ownership of The Ikoku Philanthropies by the Founder, Alvan Azinna Chibuzo Ikoku, as further described in the Policy on Company and Division Integrity.

And you further legally accept and agree that no application, interpretation, judgment, or other compliance, proceeding, or reading from, of, with, or otherwise relating to the Founding Ethics, the Codes and Policies, or any equivalent code, policy, or other document or material shall, in any way, entail any abrogation, diminishment, interference, or violation pertaining to any of the terms, conditions, principles, requirements, rights — including the attendant properties and protections — of company and organizational integrity.

Rights and Protections

Provision

Along with the above key principles, the Policy on Privacy and Confidentiality requires your adherence to correlative rights and protections further delineated below.

A — The Privacy Rights

Inalienable Right to Privacy

— that the inalienable right to privacy of persons — including the right to request privacy and have it given, respected and not violated — be actively attained, maintained, protected, and secured, be fully enjoyed and fulfilled, and be neither diminished, interfered with, nor violated.

Absolute Right, with Self

that the right of persons to privacy with the self — including privacy of communication, conversation, discourse, inquiry, learning, practice, and training by and with the self, be it in the company of oneself, in physical solitude, or in the vicinity of others — be absolute, fulfilled, fully enjoyed, protected and neither interfered with nor diminished in any manner or to any degree.

that the above right be absolute, fulfilled, fully enjoyed, protected and neither interfered with nor diminished even where such activity by and with the self is voiced, written, noted or otherwise recorded or transferred.

Absolute Right, of Self

that the right of persons to privacy of the self — including privacy of thought that entails deliberation, decision-making, reasoning, and other cognitive activities and states of conscience, creativity, emotion, imagination, intellect, mind, psyche, soul, and spirit, be it in the company of oneself, in physical solitude, or in the vicinity of others — be absolute, fulfilled, fully enjoyed, protected and neither interfered with nor diminished in any manner or to any degree.

that the above right be absolute, fulfilled, fully enjoyed, protected and neither interfered with nor diminished even where such activity of the self is voiced, written, noted or otherwise recorded or transferred.

Civil and Fundamental Rights

— that the right to privacy of persons — as a matter of civil and fundamental liberties, including the right to obtain privacy provided for in constitutions, equivalent social contracts, regulations and the professions — be actively attained, maintained, protected, and secured, be fully enjoyed and fulfilled, and be neither diminished, interfered with, nor violated.

Data and Information Rights

that the right of persons to privacy of personal biospecimens, data, and information — including as delineated and described in the Codes and Policies — be actively attained, maintained, protected, and secured, be fully enjoyed and fulfilled, and be neither diminished, interfered with, nor violated.

Organizational and Work Rights

— that the right of persons to privacy during and of administration, management, research, design, development, and other work pertaining to organizational functioning, integrity, and property — including as delineated and described in the Codes and Policies — be actively attained, maintained, protected, and secured, be fully enjoyed and fulfilled, and be neither diminished, interfered with, nor violated.

B — The Confidentiality Rights

Of Activity and Speech

— With respect to protections for privacy and confidentiality, you represent and warrant your agreement with and adherence to the following:

Protections as Essential to Mission and Purposes
that The Ikoku Philanthropies shall hold and treat the preservation of privacy and confidentiality and the protection of confidential, private and personal activity — including such activity delineated and described above in this Policy and elsewhere in the Codes and Policies — as essential to operations and the fulfillment of mission and private and public purposes.
Protections as Vital to Organization and Founder
that The Ikoku Philanthropies shall hold and treat the preservation of privacy and confidentiality, and the protection of any and all privacy and confidentiality rights, of The Ikoku Philanthropies and the Founder, Alvan Azinna Chibuzo Ikoku — including each and every right delineated and described above in this Policy and elsewhere in the Codes and Policies — as vital to existence and the fulfillment of mission and private and public purposes, and so enforce, fulfill, and protect such rights, requirements, policies, principles, and attendant assets, interests, and properties, to the fullest extent.
Confidential or Private Unless Consented
that The Ikoku Philanthropies shall base all distinctions between (a) confidential or private activity, advice, behavior, care, communication, counsel, discourse, expression, habits, learning, location, movement, planning, preparation, reading, research, speech, teaching, therapy, thought process, training, treatment, viewing, work, or other activity and any associated biospecimens, content, data, information, intellectual or real property, and (b) public, published or publishable versions of the aforementioned on (c) express written consent that such activity be, under stated terms, available for broadcasting, circulation, dissemination, distribution, evaluation, monitoring, publishing, recording, review, scrutiny, surveillance, transmission, or any other means of tracking or making public or accessible by or available to the public or persons other than the individual person concerned, identified or otherwise relating to such confidential or private activity.
Basic and Standard Protections in Distinction
that The Ikoku Philanthropies shall fulfill the duties, principles, rights, requirements, and responsibilities for consent, for express written notice and communication, for signature (especially where the Founder is concerned), for biospecimens, content, data, information, intellectual or real property, as delineated and described in the Codes and Policies, in making the above distinctions and ensuring the protection of privacy and confidentiality.
Higher Level Protections in Distinction
that The Ikoku Philanthropies shall hold and treat any and all individually or personally identifying or relating activity, advice, behavior, care, communication, counsel, discourse, expression, habits, learning, location, movement, planning, preparation, reading, research, speech, teaching, therapy, thought process, training, treatment, viewing, work, or other activity and any associated biospecimens, content, data, information, intellectual or real property to be private, and in certain circumstances also confidential — broadcasting, circulation, dissemination, distribution, evaluation, monitoring, publishing, recording, review, scrutiny, surveillance, transmission, or any other means of tracking or making public or accessible by or available to the public or persons other than the individual person concerned, identified or otherwise relating to such confidential or private activity — unless The Ikoku Philanthropies has obtained express written consent from the person concerned that such activity is to be made accessible, available or public, and where such consent is obtained, the terms for making such activity accessible, available or public with specificity equivalent to that delineated and described below.
Terms of Consent: Activity
the explicit terms of restricted (or unrestricted) permission to make such specified activity accessible, available or public.
Terms of Consent: Associated
the explicit terms of restricted (or unrestricted) permission to make all, any or certain biospecimens, content, data, information, intellectual or real property associated with such specified activity accessible, available or public.
Terms of Consent: Format, Mode
the explicit terms of restricted (or unrestricted) format, mode, or other means by which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Terms of Consent: Public, Persons
the explicit terms of restricted (or unrestricted) public or persons to which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Terms of Consent: Time
the explicit terms of restricted (or unrestricted) time — including but not limited to duration, frequency, and period — to which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Terms of Consent: Purpose
the explicit terms of restricted (or unrestricted) purpose — including but not limited to a prohibition of purposes (e.g. political, unethical, etc.) — for or with which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Terms of Consent: Operation
the explicit terms of restricted (or unrestricted) set of operations — including but not limited to a prohibition of operations (e.g. political, unethical, etc.) — for or with which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Terms of Consent: Place
the explicit terms of restricted (or unrestricted) places, sites, and other locations — including but not limited to a prohibition of places (e.g. states, countries, category of sites, etc.) — where, at or in which to make the aforementioned and specified activity and specified associated biospecimens, content, data, information, intellectual or real property accessible, available or public.
Approval and Authorization by Founder
final inspection, review, approval, and authorization of aforementioned of restricted (or unrestricted)  permission by express written instrument signed and sealed of the sole Founder, Owner, and President, Alvan Azinna Chibuzo Ikoku.
No Diminishing or Setting Aside Requirements
given the aforementioned, that The Ikoku Philanthropies must not, shall not, and will not diminish, ignore, or set aside, in any way, any of the principles, protections, requirements, rights, or conditions or terms for consent and distinctions relating to confidentiality or privacy;

— further, that The Ikoku Philanthropies must, shall, and will obtain consent directly from the person concerned (especially the Founder) and must not, shall not, and will not accept such consent from a third party, nor must, shall, or will The Ikoku Philanthropies engage, in any way, in the trade, traffic, or other transfer of personal biospecimens, content, data, information, intellectual or real property without such directly obtained consent;

— and further, that The Ikoku Philanthropies must not, shall not, and will not construe or understand that (and consequently act or operate as though) any of the aforementioned activity, devices, mind, or person of the Founder is not confidential or private or has been consented, in any way, to be made accessible, available or public or to be used as a means to make any activity and associated biospecimens, content, data, information, intellectual or real property accessible, available or public; the Founder of The Ikoku Philanthropies has been, is and will remain consistent, principled and steadfast in not consenting to any of the above or other diminishment of confidentiality or privacy.

No Person Asked or Allowed to Ignore Distinction
that no leadership, staff or committee member, employee, volunteer, representative, partner, user, visitor, customer, third party or other agent of The Ikoku Philanthropies shall construe or understand that (and consequently act or operate as though) any of the aforementioned activity — including where signaled, voiced, written or otherwise recorded, saved, transferred or transmitted — is not confidential or private without written confirmation that the above requirements for consent and distinction have been obtained are not revoked.
No Person Asked or Allowed to Breach or Reduce Protections
that no leadership, staff or committee member, employee, volunteer, representative, partner, user, visitor, customer, third party or other agent of The Ikoku Philanthropies shall be asked to or allowed to conduct any access, action, activity, disclosure, operation or participation in, on behalf of, in reference to, or more generally pertaining to The Ikoku Philanthropies that results in the breach, insecurity or reduction of privacy or confidentiality.
No Violation That Is Unlawful or Without Consent
that The Ikoku Philanthropies shall permit no violation of confidentiality or privacy that is either unlawful or without prior, express and written consent of the persons concerned.
No Activity That Violates Any Confidentiality or Privacy Laws
that The Ikoku Philanthropies shall permit no access, action, activity, disclosure, operation or participation in, on behalf of, in reference to, or more generally pertaining to The Ikoku Philanthropies that violates confidentiality or privacy laws in California, Delaware, the United States, or other nations and territories, as they now exist or as they may hereafter be amended.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

Of Data and Information

— With respect to protections for privacy and confidentiality, you also represent and warrant your agreement with and adherence to the following concerning data and information:

Protections as Essential to Mission and Purposes
that The Ikoku Philanthropies shall hold and treat the preservation of privacy and confidentiality and the protection of confidential, personal, private and sensitive data and information as essential to its operations and the fulfillment of its company mission and private and public purposes.
Protection as Valuable Proprietary Interest
that The Ikoku Philanthropies shall also claim a valuable proprietary interest in such confidential, personal, private and sensitive data and information and their protection.
Principles, Rights and Responsibilities for Data and Information
that The Ikoku Philanthropies fulfill the principles, rights, and responsibilities for the protection of the above data and information, as described in the Codes and Policies.
No Person Asked or Allowed to Breach or Reduce Protections
that no leadership, staff or committee member, employee, volunteer, representative, partner, user, visitor, customer, third party or other agent of The Ikoku Philanthropies shall be asked to or allowed to conduct any access, action, activity, operation or participation in, on behalf of, in reference to, or more generally pertaining to The Ikoku Philanthropies that results in the breach, insecurity or reduction of privacy or confidentiality of, or the protection of, the above data and information.
No Violation That Is Unlawful or Without Consent
that The Ikoku Philanthropies shall permit no violation of confidentiality or privacy that is either unlawful or without prior, express and written consent of the persons concerned.
No Use That is Unlawful or Without Consent
that The Ikoku Philanthropies shall permit no access to, use of, disclosure of or any other processing or use of any confidential or personal data and information that is either unlawful or without prior, express and written consent of the original owner of confidential or personal data and information.
No Use That Violates Any Confidentiality or Privacy Laws
that no one shall be permitted to access, disclose, or otherwise use or process confidential or personal data and information in a manner that violates confidentiality or privacy laws in California, Delaware, the United States or other nations and territories, as they now exist or as they may hereafter be amended.
No Such Use Even for Organizational Processes of Company
and that no one, as part of the establishment, development, operation, evaluation or other process of The Ikoku Philanthropies, shall access, permit the use of, disclose, permit the disclosure of or otherwise use or process any confidential or personal data and information, either during such person’s tenure with The Ikoku Philanthropies or at any time before or thereafter, in a manner that is unlawful or without prior, express and written consent of the original owner of the confidential or personal data and information.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

From Abrogation or Diminishment

— that The Ikoku Philanthropies protect itself and the Founder, as first priorities, then where reasonable other persons from, and also not allow, any access, action, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies that may abrogate or diminish any privacy or confidentiality right or protection, or facilitate such abrogation or diminishment.

From Inconsistency

— that The Ikoku Philanthropies protect itself and the Founder, as first priorities, then where reasonable other persons from, and also not permit, any any access, action, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies in a manner that conflicts with, is contrary to or is inconsistent with the most humane, respectful, robust and strict interpretations of privacy and confidentiality protections, as they are described in the Founding and Governing Code of Ethics, the Codes and Policies, founding concerns for confidentiality and privacy, and state, federal and international guidelines, law, and regulations.

From Standard Arguments

— With respect to standard arguments frequently employed to abrogate or diminish privacy and confidentiality, as well as privacy and confidentiality rights and protections, you represent and warrant your agreement with and adherence to the following:

Protection from Rationalizations of Violation
that The Ikoku Philanthropies protect itself and the Founder, as first priorities, then where reasonable other persons from, and also not permit, any access, action, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies that entails an invasion of privacy or confidentiality, or an abrogation or diminishment of privacy and confidentiality, especially where such proposed abrogation, diminishment, or violation may seem, may be, is or will be justified via standard arguments and rationalizations — to be treated as standard threats to the preservation of privacy and confidentiality, against which The Ikoku Philanthropies shall enforce and safeguard rights and their protections to the fullest extent.
Examples of Standard Arguments
that examples of such standard arguments and rationalizations include but not be limited to arguments and rationalizations pertaining to public benefit, public good, or equivalent; arguments and rationalizations pertaining to celebrity, public interest, or equivalent; arguments and rationalizations pertaining to presumed assent, presumed consent, or equivalent; arguments and rationalizations pertaining to presumed care, conservatorship, incapacity, protection, sponsorship, wardship, or equivalent; arguments and rationalizations pertaining to competition, equality, equity, fairness, justice, need, or equivalent; arguments and rationalizations pertaining to edification, education, inquiry, interviewing, learning, research, training, or equivalent; arguments and rationalizations pertaining to evaluation, review, scrutiny, supervision, transparency, or equivalent; arguments and rationalizations pertaining to data, evidence,  fact, information, knowledge, truth, or equivalent; arguments and rationalizations pertaining to broad, nebulous, nonactual, nonimmediate, nonimminent or otherwise vague danger, fear, harm, health, safety, security, threat, violence, toxicity, or equivalent; as well as “expectation of privacy,” “one-party consent,” “third-party doctrine,” “good faith” or equivalent argumentation, justification, or reasoning; all and any of the aforementioned whether made by or on behalf of individual, collective, communal, legal, natural, political, public, state or other persons, or otherwise.

And furthermore, by engaging in any activity at, by, for, in, on behalf of, with or otherwise pertaining to The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of The Ikoku Philanthropies, any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the divisions, series, subsidiaries, or affiliates, as well as any activities, affairs, areas, assets, offices, parts, properties, sections, or equivalent of the Products or Services, you accept and agree to the terms, conditions, and requirements described above, and in the Codes and Policies, in their entirety without modification.

From Violations

— that The Ikoku Philanthropies protect itself and the Founder, as first priorities, then where reasonable other persons from, and also not permit, any access, action, activity, communication, operation, participation, or other use in, with, for, on behalf of, in reference to, or otherwise pertaining to The Ikoku Philanthropies in a manner that violates (intentionally or not) local, state, federal and international guidelines, law, and regulations for confidentiality and privacy.
